Terms of Service

Last updated: October 22, 2026

These Terms of Service ("Terms") are the agreement between you and Vesperion Gate Inc. for the use of our websites and products. Using a Service means you accept the Terms that apply to it. Our Privacy Policy, our Data Processing Addendum where it applies, and any product-specific policy are part of this agreement. If you have a separately signed agreement with us, it takes precedence wherever it expressly says so.

We may revise these Terms. When a change matters, we update the date at the top of this page, record it in our policy updates, and send a notice to everyone subscribed to them, by email or feed. Where the law calls for a particular notice or a fresh agreement, we provide it separately. A revision never takes away rights you have already accrued.

Definitions

"Vesperion Gate", "we", "us" and "our" mean Vesperion Gate Inc., the Canadian company that builds and runs the Services.

The "Services" are our websites and every product we build and maintain, Thicket and LensCherry included, in whatever form they reach you: a web browser, a desktop app, a mobile app or another channel.

"You" and "your" mean the person or organization that holds an account with one or more of the Services, together with the people that account admits.

Your account

Keeping your account secure is your job: protect your password, your sessions, your API tokens and any other credential, make sure the people you invite do the same, and tell us promptly if you suspect misuse. Two-factor authentication is available to everyone and we encourage it; some Services may require it.

Everything that happens under your account is your responsibility, whether a person did it or an app, agent or bot you authorized. That covers what they post and what they change. Before you connect an app or an agent, be sure you are entitled to give it access to the information it will reach. None of this reduces our own obligations under the law or the Data Processing Addendum.

Only a person authorized to act for the account's owner may open it. Using the Services through our APIs, command-line tool, supported integrations, scripts and AI agents is allowed, including agent memberships created through our administrative controls. Creating accounts by automated means without our permission is not.

Plans, payment and refunds

A free plan is free in the plain sense: we don't ask for a card, and we don't make money from your data.

Thicket's paid plans are bought by an organization for everyone in it, clients and guests included. There are no consumer, personal, per-user or family plans.

When a Service offers a trial, we tell you its length and what happens when it ends at the moment you sign up. A Thicket trial ends on the Free plan unless you pick a paid one; other Services may restrict access when a trial ends. The Cancellation Policy explains the difference between cancelling a subscription and closing an account.

Moving from a free plan to a paid one charges your card at once and starts your billing cycle that day. Other changes between plan levels take effect, at the new rate, from the next billing cycle.

Prices don't include taxes, levies or duties. Where we have to, we collect those and pass them on to the authority concerned; otherwise they are yours to pay.

Refunds are handled under our Refund Policy.

Cancelling and ending service

Cancelling is yours to do, and the Cancellation Policy explains how. A request by email or phone does not cancel an account by itself, but if you get stuck, our support team will help.

Ending a subscription stops future renewals; it does not by itself delete your content. Closing a Thicket account ends access to the workspace and starts a 30-day recovery period; LensCherry gives you 30 days to withdraw a deletion request. When that period ends, removal from our active systems is scheduled. Ordinary recovery backups of customer content keep copies for at most 28 days and are purged within 60 days of closure. Security, billing, configuration and legally required records follow the separate periods in the Privacy Policy. Export anything you want to keep before you close an account.

If you cancel a paid subscription, your access continues to the end of the period you have paid for, and no further charge is made. We do not prorate the unused part of a final billing cycle automatically; the Refund Policy has the details.

We may suspend or end access for non-payment, abuse, a security risk, a material breach of these Terms or another lawful reason. Where it is practical and the law allows, we give notice and a chance to put things right or to export content first; where people or the Services need protecting, we act at once. What happens to the account and its content then follows the Cancellation Policy and the law.

Abusing our staff, whether in words, in writing, physically or by threats, ends an account immediately.

Changes to the Services and prices

We mean to keep running our Services for as long as it is possible and reasonable to, and to keep looking after security, privacy and support for older ones. Even so, a feature can become impossible to maintain, a part of a product can be redesigned because we believe it can be better, or a product can close to new signups. We may change or discontinue any part of the Services at any time, temporarily or for good, with or without notice.

Our prices change from time to time. When they do, existing customers are usually left on their current price, but we reserve the right to change it for them too. In that case we give at least 30 days' notice to the email address on the account, and we may also announce the change on our websites or inside the affected Service.

Availability, security and privacy

You use the Services at your own risk. We provide them as they are and as they are available, without a service-level agreement, though we take uptime seriously and publish our current status.

If an account's usage is far above what other customers generate, we may disable it temporarily. We contact the account owner before doing so, unless the usage is already degrading the Service for others.

We protect your data with backups, redundant systems and encryption, and all traffic between you and the Services over the public internet is encrypted. The Trust and Security page describes these measures, and the Security Response page explains how to report a vulnerability or an incident.

We process your data only as the Privacy Policy describes. Our staff look at your data in a few situations only:

  • When you ask for help and have given your express consent for us to look inside your account.
  • When an automated process fails partway. We are alerted when that happens. If the fix can be made and the process restarted without looking at personal data, that is what we do; occasionally the minimum of personal data has to be looked at to find the cause.
  • When the security of your data or the Services calls for it. Logs and metadata are examined to keep both secure, and an account may be opened during the investigation of an abuse report.
  • When the law requires it. We assess every request, limit disclosure to what the law or an emergency demands, and notify the affected customers unless that is prohibited or an emergency makes prior notice inappropriate. Our infrastructure is in the United States, and our providers may receive lawful requests in the countries where they process data; the Privacy Policy has the details.

We rely on third-party providers for hosting, storage, networking, email and the other services the Services need. Our provider register lists every provider that handles personal data.

Where the California Consumer Privacy Act applies to personal information we process for you, we act as your service provider or contractor under the Data Processing Addendum; our own account, billing and business operations are described in the Privacy Policy, and you must meet your own obligations under that law. The Data Processing Addendum is part of these Terms whenever the GDPR, the UK GDPR, PIPEDA or a similar law governs personal data you process with the Services.

Content and ownership

What you and your users post must respect copyright law, including Canada's Copyright Act and the law where you live. Our Copyright Infringement Claims page explains how to tell us about infringing material.

Your content stays yours. You give us only the permissions we need to host, transmit, process and display it in order to run the service you asked for, carry out your instructions, keep it secure and meet our legal duties, and providers acting for us may use it only within those arrangements. We will ask separately before using private customer content in marketing. Using Thicket, or authorizing an integration with it, gives us no right to train general-purpose AI models on that content.

We do not screen Thicket workspace content in advance. LensCherry screens images automatically for safety and may involve human review of flagged or reported content. We may refuse or remove content that breaks these Terms or the law.

The Services themselves, including their software, design and brand, belong to Vesperion Gate or its licensors, and using them gives you no ownership interest in them. Do not copy or reuse their code, styling or design without our written permission, and ask us before using our logos or a Service's logo in promotion; permission we grant can be withdrawn if you break these Terms. Reselling, copying or otherwise exploiting the Services, access to them or their use requires our express written permission.

APIs, command-line tools, connectors and agents

Thicket offers an API, a command-line tool and an MCP connector. Using any of them, directly or through a third-party product, an AI assistant or an agent, is governed by these Terms and by this section.

We are not responsible for loss or damage arising from your use of those interfaces or from third-party products that reach your data through them. Connecting a product tells us to share what your access allows, within the access you approved, and that product's own terms decide what it does with what it reads. The Privacy Policy describes the data flow and how to disconnect.

An application that records, monitors or reports on a Service user's activity, inside or outside the Services, may not use the API, except to track time. We decide, at our discretion, whether an integration crosses that line, and an integration built for surveillance has to go.

Excessive or abusive requests can lead us to suspend an account's access, temporarily or permanently, at our discretion. We try to warn the account owner first; where usage threatens or has caused an outage, we may cut access without warning.

Other companies may build integrations between their services and ours. We are not responsible for them. Nothing here limits our responsibility for our own systems and the providers we engage, or any duty the law does not let us exclude.

AI Services Terms

The following provisions apply to LensCherry and any other feature expressly identified as subject to these AI image-generation and editing terms ("AI Services"). They do not apply merely because you access Thicket through an independently selected AI tool. Such access is governed by the general Terms and the integration provisions above.

Age Requirements

By using AI Services, you confirm that you are at least 18 years old or have reached the legal age of majority in your country of residence, whichever is higher. If you are under 18 or the legal age in your country, you are prohibited from using AI Services.

You must not upload, submit, or use any photographs or content depicting minors (individuals under the age of 18) in connection with AI Services. This prohibition applies regardless of whether the minor is you, a family member, or any other person.

Consent for Using Others' Likeness

AI Services use reference-image profiles to generate images of yourself or other adults who have given explicit consent. The current LensCherry workflow uses these references during generation and does not train separate model weights for each person. When creating a profile or generating images of another person, you must:

  • Obtain their express written consent to use their photos
  • Obtain their express written consent to process their photos through the identified providers and generate images depicting them
  • Confirm they are over 18 years old (or the legal age in their respective country, whichever is higher)
  • Confirm they are not a politically exposed person

By creating a reference-image profile or generating images of a person, you confirm that the person is you or that you have obtained the required consent.

Prohibited Uses of AI Services

You agree NOT to use AI Services to create, generate, or distribute content that:

  • Depicts minors in any context
  • Contains nudity, pornography, or sexually explicit material
  • Impersonates real individuals without their explicit consent
  • Creates deepfakes intended to deceive, defraud, or mislead others
  • Engages in or promotes scams, fraud, or other misleading activities
  • Promotes or sells illegal products, services, or content
  • Engages in political campaigning, advocacy, or misinformation
  • Violates privacy or portrays individuals in a harmful or false light
  • Contains violent, hateful, or discriminatory content
  • Creates false photography or documents to breach accounts or commit fraud
  • Exploits or abuses children in any way
  • Generates or disseminates verifiably false information intended to harm others
  • Implies or promotes support of a terrorist organization
  • Condones or promotes violence against people based on any protected legal category

You agree to use AI Services only for lawful and ethical purposes.

Content Monitoring and Reporting

We reserve the right to monitor and review any content uploaded to or generated by AI Services. If we identify content that violates these Terms, including content featuring minors, we will:

  • Immediately remove such content
  • Terminate your account
  • Report instances of potential child exploitation, endangerment, or abuse to appropriate law enforcement authorities

By using AI Services, you consent to such monitoring, review, and reporting. You understand that you may be subject to legal consequences if you violate these Terms.

AI-Generated Content Ownership

As between you and Vesperion Gate, you retain your input rights and own the images and assets generated at your direction ("AI Assets") to the extent ownership rights exist. We assign to you any rights we have in those outputs. This does not guarantee copyright protection, exclusivity, or freedom from third-party rights; others may receive similar outputs.

The limited content permissions in the Copyright and Content Ownership section apply to AI inputs and outputs. We do not receive a perpetual promotional license to your private photos, prompts, or generated images. We will ask for separate permission before using them in marketing. Processing and backup copies follow the Privacy Policy and applicable data-processing terms.

AI Services Refunds

LensCherry currently sells one-time credit packs, not recurring subscriptions. Purchased credits do not expire while the account remains open. Used credits are generally non-refundable because generation consumes processing resources, subject to platform-failure remedies and applicable law. Any subscription purchased under our earlier 7-day guarantee remains eligible under that guarantee. Please see our Refund Policy for full details.

Intellectual Property and AI-Generated Content

AI Services utilize artificial intelligence systems to produce AI Assets. Such assets may be unintentionally similar to copyrighted material or trademarks held by others. We respect rights holders and ask our users to do the same.

You are solely responsible for ensuring that your use of AI Assets does not infringe upon the intellectual property rights of others. We are not liable for any claims arising from the similarity of AI Assets to existing copyrighted works or trademarks.

AI Services Disclaimer

AI Services are provided "as is" without warranty of any kind. We do not guarantee that AI-generated content will be accurate, appropriate, or suitable for any particular purpose. You are solely responsible for reviewing and approving all AI Assets before use.

Liability

To the extent the law allows, Vesperion Gate is not liable to you or to anyone else for damages of any kind arising from the use of the Services, from being unable to reach your data, or from unauthorized access to your data or account, nor for the acts of any third party using the Services or any other consequence of these Terms or the Services. Liability that cannot lawfully be excluded or limited is not excluded or limited by these Terms, and mandatory consumer rights, together with the rights and remedies in the Data Processing Addendum and any applicable Standard Contractual Clauses, remain unaffected.
