# Terms of Service Archived published version, last updated 2026-09-04. Last updated: September 4, 2026 These Terms of Service ("Terms") govern use of Vesperion Gate products and services. By using a Service, you agree to the Terms that apply to it. Our [Privacy Policy](https://www.vesperiongate.com/policies/privacy), [Data Processing Addendum](https://www.vesperiongate.com/policies/dpa) where applicable, and product-specific policies form part of this agreement. A separately signed agreement takes precedence where it expressly provides otherwise. We record revisions in our [policy update history](https://www.vesperiongate.com/policies/updates). For material changes affecting customers, we will provide notice in the affected product or to an account contact email, with advance notice and any additional agreement or consent required by law. The published revision date does not replace required notice. Changes do not retrospectively remove accrued rights. ## Definitions "Company", "we", "our", or "us" in any of our policies or terms, refers to Vesperion Gate Inc. "Services" refers to our websites and any product created and maintained by Vesperion Gate Inc., whether delivered within a web browser, desktop application, mobile application, or another format. Finally, "you" or "your" refers to the people or organizations that own an account with one or more of our Services. ## Account Terms You are responsible for maintaining the security of your account and password and for ensuring that any of your users do the same. You should protect passwords, sessions, API tokens, and other credentials and promptly report suspected misuse. We recommend all users set up two-factor authentication for added security. In some of our Services, we may require it. You are responsible for users and tools you authorize, including their activity and submitted content. Before connecting a tool, ensure that you have authority to give it access to the affected information and meet applicable notice, consent, confidentiality, and other legal requirements. Review granted access and supervise automated actions in proportion to their consequences. This does not limit our own obligations under applicable law or the Data Processing Addendum. An account must be established by a person authorized to act for its owner. Supported APIs, command-line tools, integrations, scripts, and AI agents are permitted, including agent memberships created through our administrative controls. Unauthorized automated account registration is prohibited. ## Payment, Refunds, and Plan Changes If you are using a free version of one of our Services, it is really free: we do not ask you for your credit card or sell your data. Thicket's paid plans are organization subscriptions for business and team use. An organization owner buys one plan for the whole organization, including any clients or guests it invites. Thicket does not offer consumer, personal, per-user, or family plans. If a Service offers a trial, the length and the result of the trial are shown when you sign up. Thicket's trial moves to its Free plan unless you choose a paid plan. Other Services may limit access when a trial ends. See our [Cancellation Policy](https://www.vesperiongate.com/policies/cancellation) for the distinction between cancelling a subscription and closing an account. If you are upgrading from a free plan to a paid plan, we will charge your card immediately and your billing cycle starts on the day of upgrade. For other upgrades or downgrades in plan level, the new rate starts from the next billing cycle. All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities. Where required, we will collect those taxes on behalf of the taxing authority and remit those taxes to taxing authorities. Otherwise, you are responsible for payment of all taxes, levies, or duties. We process refunds according to our [Refund Policy](https://www.vesperiongate.com/policies/refunds). ## Cancellation and Termination You are solely responsible for properly canceling your account. You can find instructions for how to cancel your account in our [Cancellation Policy](https://www.vesperiongate.com/policies/cancellation). An email or phone request to cancel your account is not automatically considered cancellation. If you need help canceling your account, you can always contact our Support team. Cancelling a subscription stops future renewal and does not by itself delete your account content. Thicket account closure ends workspace access and begins a 30-day recovery period. LensCherry offers 30 days to cancel an account-deletion request. Permanent removal from active systems is scheduled when that period ends. Ordinary customer-content recovery backups use a 28-day maximum retention window, with no monthly or annual database tier, and are scheduled for deletion within 60 days of account closure. Security, billing, configuration, and legally required records have separate retention rules described in the Privacy Policy. Export anything you need before closing the account. If you cancel a paid subscription, you will retain access through the end of the current billing period and will not be charged again. We do not automatically prorate unused time in the last billing cycle. See our [Refund Policy](https://www.vesperiongate.com/policies/refunds) for more details. We may suspend or terminate access for non-payment, abuse, security risk, a material breach of these Terms, or another lawful reason. Where practical and legally permitted, we will provide notice and an opportunity to resolve the issue or export content. We may act immediately to protect users or the service. Termination and deletion follow the Cancellation Policy and applicable legal requirements. Verbal, physical, written or other abuse (including threats of abuse or retribution) of a Company employee or officer will result in immediate account termination. ## Modifications to the Service and Prices We intend to support our Services for as long as it is possible and reasonable to do so. That means when it comes to security, privacy, and customer support, we will continue to maintain any legacy Services. Sometimes it becomes technically impossible to continue a feature or we redesign a part of our Services because we think it could be better or we decide to close new signups of a product. We reserve the right at any time to modify or discontinue, temporarily or permanently, any part of our Services with or without notice. Sometimes we change the pricing structure for our products. When we do that, we tend to exempt existing customers from those changes. However, we may choose to change the prices for existing customers. If we do so, we will give at least 30 days notice and will notify you via the email address on record. We may also post a notice about changes on our websites or the affected Services themselves. ## Uptime, Security, and Privacy Your use of the Services is at your sole risk. We provide these Services on an "as is" and "as available" basis. We do not offer service-level agreements, but do take uptime of our applications seriously. We reserve the right to temporarily disable your account if your usage significantly exceeds the average usage of other customers of the Services. We'll reach out to the account owner before taking any action except in rare cases where the level of use may negatively impact the performance of the Service for other customers. We take many measures to protect and secure your data through backups, redundancies, and encryption. We enforce encryption for data transmission from the public Internet. You agree that Vesperion Gate may process your data as described in our [Privacy Policy](https://www.vesperiongate.com/policies/privacy) and for no other purpose. On rare occasion, our staff may access your data for the following reasons: - **To help you with support requests you make.** We'll ask for express consent before accessing your account. - **To fix errors.** On the rare occasions when an error occurs that stops an automated process partway through, we get automated alerts. When we can fix the issue and restart automated processing without looking at any personal data, we do. In rare cases, we have to look at a minimum amount of personal data to fix the issue. - **To safeguard Vesperion Gate.** We'll look at logs and metadata as part of our work to ensure the security of your data and the Services as a whole. If necessary, we may also access accounts as part of an abuse report investigation. - **To the extent required by applicable law.** We assess legal requests, limit disclosure to what is required or legally permitted for an emergency, and notify affected customers unless prohibited or an emergency makes prior notice inappropriate. Our infrastructure is in the United States; providers may also face lawful requests in their processing countries. See the Privacy Policy for details. We use third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Services. Where the CCPA applies to customer personal information we process on your behalf, our service-provider or contractor obligations are set out in the Data Processing Addendum. Our separate account administration, billing, and business operations are described in the Privacy Policy. You must also meet your applicable data-protection obligations. ## Copyright and Content Ownership All content posted on the Services must comply with applicable copyright law, including the Canadian Copyright Act and the copyright laws of the jurisdiction in which you reside. You retain your rights in content you and your users provide. You grant us the limited permissions needed to host, transmit, process, and display it to provide the requested service, carry out authorized instructions, maintain security, and meet legal obligations. Providers acting for us may use it only within the applicable processing arrangements. We require separate permission to use private customer content in marketing. Ordinary use of Thicket or authorization of an integration grants us no permission to train general-purpose AI models on that content. We do not routinely pre-screen Thicket workspace content. LensCherry uses automated image safety screening and may involve authorized review of flagged or reported content. We may refuse or remove content that violates these Terms or applicable law. The Company or its licensors own all right, title, and interest in and to the Services, including all intellectual property rights therein, and you obtain no ownership rights in the Services as a result of your use. You may not duplicate, copy, or reuse any portion of the HTML, CSS, JavaScript, or visual design elements without express written permission from the Company. You must request permission to use the Company's logos or any Service logos for promotional purposes. We reserve the right to rescind any permissions if you violate these Terms. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Services, use of the Services, or access to the Services without the express written permission of the Company. ## APIs, CLI tools, integrations, and agents These Terms apply to supported APIs, official command-line tools, connectors including MCP, and agent accounts. Operations and limits differ by interface. Access remains subject to the connected account's current permissions, credential scope, plan limits, and abuse-prevention controls. Authorizing an external tool directs us to process its permitted requests and return information within that access. Its operator and AI providers may receive content even with read-only access. Their retention, training, review, processing locations, charges, and terms depend on the agreement and settings you or your organization has with them. Compatibility does not mean endorsement or make a customer-selected provider our subprocessor. Automated tools can produce inaccurate content, disclose information, notify people, or make unintended changes. Choose appropriate access, protect credentials, and review output and consequential actions. Disconnecting prevents subsequent requests using that authorization; it does not undo actions or delete external copies. The [connection help](https://www.thickethq.com/help/mcp) and [Privacy Policy](https://www.vesperiongate.com/policies/privacy#connected-tools) explain controls and data handling. Do not submit payment-card data, protected health information, government identifiers, or authentication secrets as MCP tool content. Use the designated authentication channels for credentials. Do not use connectors to circumvent permissions, platform restrictions, or legal duties. This intended-use restriction does not claim that free-text project content is automatically screened or incapable of containing sensitive information. - Integrations may not be used for unlawful or covert surveillance. We may remove integrations that violate this restriction. - Abuse, excessive requests, or security risks may result in restriction or suspension. We will attempt to notify the account owner first when practical; immediate action may be necessary to protect users or availability. - We do not control independently selected tools or promise their availability or suitability. This does not exclude our responsibility for our systems or providers we engage, or any obligation that applicable law does not permit us to exclude. ## AI Services Terms The following provisions apply to LensCherry and any other feature expressly identified as subject to these AI image-generation and editing terms ("AI Services"). They do not apply merely because you access Thicket through an independently selected AI tool. Such access is governed by the general Terms and the integration provisions above. ### Age Requirements By using AI Services, you confirm that you are at least 18 years old or have reached the legal age of majority in your country of residence, whichever is higher. If you are under 18 or the legal age in your country, you are prohibited from using AI Services. You must not upload, submit, or use any photographs or content depicting minors (individuals under the age of 18) in connection with AI Services. This prohibition applies regardless of whether the minor is you, a family member, or any other person. ### Consent for Using Others' Likeness AI Services use reference-image profiles to generate images of yourself or other adults who have given explicit consent. The current LensCherry workflow uses these references during generation and does not train separate model weights for each person. When creating a profile or generating images of another person, you must: - Obtain their express written consent to use their photos - Obtain their express written consent to process their photos through the identified providers and generate images depicting them - Confirm they are over 18 years old (or the legal age in their respective country, whichever is higher) - Confirm they are not a politically exposed person By creating a reference-image profile or generating images of a person, you confirm that the person is you or that you have obtained the required consent. ### Prohibited Uses of AI Services You agree NOT to use AI Services to create, generate, or distribute content that: - Depicts minors in any context - Contains nudity, pornography, or sexually explicit material - Impersonates real individuals without their explicit consent - Creates deepfakes intended to deceive, defraud, or mislead others - Engages in or promotes scams, fraud, or other misleading activities - Promotes or sells illegal products, services, or content - Engages in political campaigning, advocacy, or misinformation - Violates privacy or portrays individuals in a harmful or false light - Contains violent, hateful, or discriminatory content - Creates false photography or documents to breach accounts or commit fraud - Exploits or abuses children in any way - Generates or disseminates verifiably false information intended to harm others - Implies or promotes support of a terrorist organization - Condones or promotes violence against people based on any protected legal category You agree to use AI Services only for lawful and ethical purposes. ### Content Monitoring and Reporting We reserve the right to monitor and review any content uploaded to or generated by AI Services. If we identify content that violates these Terms, including content featuring minors, we will: - Immediately remove such content - Terminate your account - Report instances of potential child exploitation, endangerment, or abuse to appropriate law enforcement authorities By using AI Services, you consent to such monitoring, review, and reporting. You understand that you may be subject to legal consequences if you violate these Terms. ### AI-Generated Content Ownership As between you and Vesperion Gate, you retain your input rights and own the images and assets generated at your direction ("AI Assets") to the extent ownership rights exist. We assign to you any rights we have in those outputs. This does not guarantee copyright protection, exclusivity, or freedom from third-party rights; others may receive similar outputs. The limited content permissions in the Copyright and Content Ownership section apply to AI inputs and outputs. We do not receive a perpetual promotional license to your private photos, prompts, or generated images. We will ask for separate permission before using them in marketing. Processing and backup copies follow the Privacy Policy and applicable data-processing terms. ### AI Services Refunds LensCherry currently sells one-time credit packs, not recurring subscriptions. Purchased credits do not expire while the account remains open. Used credits are generally non-refundable because generation consumes processing resources, subject to platform-failure remedies and applicable law. Any subscription purchased under our earlier 7-day guarantee remains eligible under that guarantee. Please see our [Refund Policy](https://www.vesperiongate.com/policies/refunds) for full details. ### Intellectual Property and AI-Generated Content AI Services utilize artificial intelligence systems to produce AI Assets. Such assets may be unintentionally similar to copyrighted material or trademarks held by others. We respect rights holders and ask our users to do the same. You are solely responsible for ensuring that your use of AI Assets does not infringe upon the intellectual property rights of others. We are not liable for any claims arising from the similarity of AI Assets to existing copyrighted works or trademarks. ### AI Services Disclaimer AI Services are provided "as is" without warranty of any kind. We do not guarantee that AI-generated content will be accurate, appropriate, or suitable for any particular purpose. You are solely responsible for reviewing and approving all AI Assets before use. ## Liability To the extent permitted by applicable law, we are not liable for indirect or consequential loss arising from use of the Services or independently selected integrations. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, or removes our duties for our own processing, security, confidentiality, or service providers under applicable law or the Data Processing Addendum. Mandatory consumer rights and the rights and remedies in applicable Standard Contractual Clauses remain unaffected. If you have a question about any of these Terms, please contact our Support team.
